With Donald Trump and the Republican Party set to resume control of the White House from 20 January, there's a lot we don't know about the policies of the incoming administration and how they will impact LGBTQ people in the US.

Likely points of focus - as detailed in the incoming administration's Project 2025 policy agenda - will be the rollback of anti-discrimination protections, the persecution of trans people, the unwinding of marriage equality, and the criminalisation with porn.

One of the complexities of the US political system is that there is law-making at the federal level, law-making at the state level, as well as law interpretation by the Supreme Court. For example, it was only as a result of a Supreme Court decision in 2003 that same-sex sexual activity has been legal in all US states. There's a lot of moving parts in how the legal framework operates.

Because of the complexity of the law-making framework, we can see some of the chess pieces of the christo-fascist policy agenda already being advanced. For example, let's look at what's happening with the regulation of porn.

At the state-level, we're seeing a general move to require major porn content platforms - such as PornHub - to implement robust age-verification processes. In theory this would prevent anyone under the age of 18 from accessing porn from these platforms.

While age-verification requirements seem sensible at face-value they generally require a lot of data collection on users and are practically impossible to implement.

With age-verification not a viable option, numerous states have now moved to simply ban access to major porn content platforms such as PornHub. At the time of writing, the number of states that have implemented porn bans stands at 17.

Those states are:

  • Alabama
  • Arkansas
  • Idaho
  • Indiana
  • Kansas
  • Kentucky
  • Mississippi
  • Montana
  • Nebraska
  • North Carolina
  • Oklahoma
  • Texas
  • Utah
  • Virginia

It is looking likely that both Georgia and Louisiana will soon be added to that list.

Obviously, porn content platforms are not the only way to access porn, and a VPN can be used to mask your location and get around the blocks that are currently in place. But what's worrying is the underlying intention of law-makers and the determination to unpick the principle that individuals have a "right to privacy".

It was a 1969 Supreme Court decision [Stanley v. Georgia] that established that possession of pornography was not a crime. In the decades preceding that, numerous creators and distributors of erotic content were arrested and imprisoned for distributing porn - the kind of content that most people would describe as fairly vanilla.

If you're an OnlyFans content creator and you live in a state that is implementing porn bans, will you be potentially at risk of arrest and prosecution for breaching state laws? That seems to be the direction that we're heading in.

What can be done about it? The go-to response when we're talking about trying to effect political change is to make sure you vote and that your voice is heard, but the US has just done that and it seems like christo-fascism neo-conservatism is what the majority of people in the country have voted for. So, here we are.
