Following an investigation by the United States Attorney for the Southern District of New York, Austin Wolf - who's government name is Justin Heath Smith, aged 43 - has been charged with one count of distribution and receipt of child pornography, and one count of possession of child pornography.

He is being held in detention in Brooklyn after a judge ruled that he was a danger to the public and a flight risk

According to the announcement released by the investigating officers, the charges relate to content that Wolf/Smith has allegedly sent and received using the Telegram app, as well as videos that were found in his Manhattan apartment.

The FBI searched Wolf/Smith's Manhattan apartment in April, obtaining evidence relating to the charges.

If found guilty in relation to these charges, Wolf/Smith could face prison time of 5-20 years.

Wolf/Smith was scheduled to attend a preliminary hearing in court on 29 July, however that date has been postponed a number of times - by agreement between the parties. Wolf/Smith was expected to appear in court on 27 September, however this has been postponed again until 28 October.

Commentators suggest that this indicates that a plea deal is being negotiated.
